Terms of Service

These Terms and Conditions (the “Terms”), together with any supplemental policies or documents, constitute the entire agreement between you and nixo (collectively, “we,” “us,” or “nixo”). By accessing or using the Service in any manner, you acknowledge that you have read, understood, and agree to be bound by all of the following provisions.

We reserve the right to update or modify these Terms at any time in our sole discretion. Changes will be identified by an updated “Effective” date at the beginning of this page. You waive any right to receive individual notice of such changes. Your continued use of the Service after any revision constitutes acceptance and agreement to the modified Terms.

The Service is not designed to comply with industry-specific regulatory requirements, such as HIPAA or FISMA. If your use is subject to such regulations, you may not use the Service. The Service is intended for users who are at least 18 years old. By using the Service, you represent that you meet this age requirement.

All source code, software, database schemas, website designs, user interface elements, graphics, logos, and documentation comprising the Service (collectively, the “Content”) are the exclusive property of nixo or its licensors and are protected by applicable copyright, trademark, and intellectual property laws. No Content may be copied, reproduced, republished, distributed, sold, licensed, or commercially exploited in any manner without our express prior written consent.

Subject to your compliance with these Terms, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the Service solely for its intended purpose. All rights not expressly granted herein remain with nixo.

Upon registration, you will receive an API key that serves as your authentication credential. You are fully responsible for:

• The confidentiality of your API key and any dashboard credentials
• All activity conducted under your account or API key, whether or not authorized by you
• Promptly notifying us of any unauthorized access or security breach affecting your account

You may not share, sell, rent, or transfer your API key or account access to any third party. Providing false or misleading information during registration may result in immediate account termination. We reserve the right to monitor new accounts and to suspend, deactivate, or permanently delete any account in our sole discretion, with or without cause and with or without notice. If your account is terminated for policy violations, you may not create a replacement account.

By using the Service, you represent and warrant that:

• All information you provide is truthful, accurate, current, and complete
• You will maintain your information and promptly update it when necessary
• You have full legal capacity to enter into and comply with these Terms
• You are at least 18 years old
• You will not access the Service through automated means (bots, scrapers, or similar), except through the designated API endpoints
• You will not use the Service for illegal or unauthorized purposes
• Your use will not violate any applicable law or regulation

If any of the foregoing representations is found to be untrue, inaccurate, or incomplete, we reserve the right to suspend or terminate your account and deny any current or future access to the Service.

All plans are paid for in advance. There are no automatic subscriptions or recurring charges unless expressly stated otherwise. Prices may change at any time; however, access already purchased will be honored at the price originally paid.

Refunds are governed exclusively by our Refund Policy ( https://nixo.codes/refund). By completing a purchase, you confirm that you have read and accepted the Refund Policy in its entirety.

The Service may only be used for its intended purpose. You agree not to:

• Use the Service for illegal, fraudulent, or unauthorized purposes
• Violate Anthropic’s usage policies or any other upstream provider policies
• Attempt to bypass, disable, or interfere with usage limits, rate limiting, authentication mechanisms, or security features of the Service
• Resell, sublicense, or distribute access to the Service without express written permission
• Reverse engineer, decompile, or disassemble any part of the software or infrastructure of the Service
• Systematically extract data, scrape, or harvest Content from the Service or dashboard
• Use the Service to create, train, or improve competing products or services
• Disrupt, impair, or place excessive load on the Service or its connected infrastructure
• Upload, transmit, or introduce malicious code, viruses, or material intended to damage or compromise the Service
• Impersonate any person, user, or entity
• Create multiple accounts to circumvent restrictions or abuse promotional offers
• Harass, threaten, or intimidate other users or nixo employees
• Sell, transfer, or trade your account for monetary or other consideration
• Attempt to attack, exploit, or compromise the security of our servers or infrastructure
• Disparage or defame nixo or the Service with the intent to cause reputational harm

The Service is subject to a Fair Use Policy. We expect all users to consume resources in a manner that is reasonable and consistent with normal usage patterns. The following activities constitute violations of our Fair Use Policy:

• Excessive or disproportionate use that substantially exceeds typical consumption patterns for your plan level
• Sending large volumes of requests in rapid succession (spamming), including automated request floods or programmatic abuse
• Knowingly wasting or consuming provider capacity in a manner that degrades service quality for other users
• Exploiting pricing structures, promotional offers, or plan features in a manner contrary to their intended purpose
• Any other conduct that we reasonably determine, in our discretion, to constitute abuse of the Service or its resources

We reserve the right to determine in our sole discretion what constitutes a violation of this Fair Use Policy. If we determine that your usage violates this policy, we may throttle, suspend, or permanently terminate your account without prior notice. Accounts suspended or terminated for Fair Use violations are not entitled to refunds of prepaid fees, credits, or unused balances.

We may implement and enforce automated usage limits, rate controls, or other technical measures at any time to ensure compliance with this policy. Such measures may be applied or adjusted at any time without prior notice.

The Service integrates with and depends on third-party services, including, but not limited to, the Anthropic API and Cloudflare infrastructure. We do not control, endorse, or assume responsibility for the content, policies, availability, or practices of third parties. Your interactions with third-party services are governed by their respective terms and policies, and you use them at your own risk.

Any links to external websites or resources provided through the Service are provided for convenience only. We are not liable for any loss or damage resulting from your use of or reliance on third-party services, content, or products.

We reserve the right, but do not assume the obligation, to:

• Monitor the Service for violations of these Terms
• Take appropriate action, including legal action, against anyone who violates these Terms or applicable law
• Restrict, limit, or disable access to any feature or part of the Service in our sole discretion
• Remove or disable Content or features that are excessive, burdensome, or objectionable
• Manage the Service to protect our rights, property, and the proper functioning of the platform

We do not guarantee uninterrupted or error-free provision of the Service. The Service relies on third-party infrastructure, including Cloudflare and Anthropic, and may experience outages, interruptions, or performance degradation due to factors beyond our control. We may perform maintenance, provide updates, or modify features at any time, with or without prior notice. We are not obligated to maintain backward compatibility or provide fixes, patches, or updates.

You retain full ownership of all content you submit through the Service.

We do not log, inspect, or store the content of your API requests or responses—your data is forwarded to Anthropic and subject to their policies.

We collect only usage metadata (token counts, model identifiers, timestamps, status codes) as described in our Privacy Policy.

We retain certain operational data related to your use of the Service for performance monitoring and analysis. Although we perform routine data backups, you are solely responsible for all data you submit. We assume no liability for the loss or corruption of your data, and you waive all claims against us arising from such events.

These Terms remain in effect for the duration of your use of the Service. We reserve the right to deny access, suspend, or terminate your account at any time, for any reason, with or without notice or liability. This includes, among other things, blocking specific IP addresses, revoking API keys, and deleting account data.

If your account is terminated for a violation of these Terms, you are prohibited from registering a new account under your own name, an alias, or on behalf of a third party. We reserve the right to pursue all available remedies in addition to account termination.

You may stop using the Service at any time. Prepaid fees are non-refundable upon termination unless otherwise provided in our Refund Policy.

These Terms are governed by German law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Venue shall be Wildeshausen, provided you are a merchant, a legal entity under public law, or a special fund under public law.

For consumers: If your habitual residence is in Germany, you may bring proceedings before the court at your place of residence. Consumers within the meaning of Section 13 of the German Civil Code (BGB) are natural persons who enter into a legal transaction for a purpose that cannot be attributed to their commercial or independent professional activity.

Our failure to enforce any provision of these Terms does not constitute a waiver of that or any other provision. If any part of these Terms is found to be unlawful, void, or unenforceable, that part will be severed without affecting the validity of the remaining provisions. These Terms apply to the fullest extent permitted by law.

We may assign our rights and obligations under these Terms to any party at any time. We are not liable for failures or delays in performance caused by circumstances beyond our reasonable control.

These Terms do not create a joint venture, partnership, employment, or agency relationship. You agree that these Terms will not be construed against us because we drafted them. You waive any objections based on the electronic form of these Terms or the absence of physical signatures.
